These Terms and Conditions ("Terms") govern your use of the "Water Plant – Watering Reminder" mobile application (the "App") provided by WebMateDigital OU ("we," "our," or "us"). By downloading and using the App, you agree to abide by these Terms.

1. Use of the App:

1.1 Eligibility:

You must be at least 18 years old or have the consent of a legal guardian to use the App.

1.2 License:

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

2. Subscription Services:

2.1 Payment and Auto-Renewal:

The App offers subscription services with auto-renewable options for monthly, semi-annual, and annual periods. Payment is handled through Apple, and subscriptions automatically renew unless canceled.

2.2 Billing Disputes:

Any billing disputes related to subscriptions must be addressed with Apple, and we are not responsible for refund requests.
 

3. User Accounts:

3.1 Registration:

To use certain features of the App, you may need to create an account. You agree to provide accurate and complete information during registration.

3.2 Account Security:

You are responsible for maintaining the security of your account credentials. Notify us immediately of any unauthorized access or use.
 

4. Privacy:

Our Privacy Policy governs the collection, use, and storage of personal information. By using the App, you agree to the terms outlined in our Privacy Policy.

5. Third-Party Services:

The App utilizes services such as AdMob, Google Analytics for Firebase, and Amplitude. Please refer to the privacy policies of these services for additional information.

6. Termination:

We reserve the right to terminate or suspend your access to the App at our discretion, without prior notice, for any reason, including if you violate these Terms.

7. Changes to Terms:

We may update these Terms periodically. By continuing to use the App, you agree to be bound by the most current version of these Terms.

Apps License and Use:

The "Water Plant – Watering Reminder" mobile application ("Licensed Application") available through the App Store is licensed, not sold, to you. Your license is subject to your acceptance of this Licensed Application End User License Agreement ("Standard EULA").

a. Scope of License:

Licensor grants you a nontransferable license to use the Licensed Application on Apple-branded products as permitted by the Usage Rules. You may not distribute or make the App available over a network for simultaneous use by multiple devices.

b. Consent to Use of Data:

You agree that Licensor may collect and use technical data to facilitate software updates, product support, and other services related to the App. Licensor may use this information in an anonymized form to improve its products.

c. Termination:

This Standard EULA is effective until terminated by you or Licensor. Your rights under this Standard EULA will terminate automatically if you fail to comply with any of its terms.

d. External Services:

The Licensed Application may enable access to third-party services and websites ("External Services"). You use External Services at your own risk. Licensor is not responsible for the content or accuracy of third-party External Services.

e. NO WARRANTY:

The App is provided "AS IS" and "AS AVAILABLE," without any warranty. Licensor disclaims all warranties and conditions, including but not limited to, merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement.

f. Limitation of Liability:

Licensor shall not be liable for any incidental, special, indirect, or consequential damages arising out of or related to your use of the App. In no event shall Licensor's total liability exceed fifty dollars ($50.00).

g. Export Restrictions:

You may not export the Licensed Application except as authorized by United States law. You represent that you are not located in a U.S.-embargoed country and will not use the App for prohibited purposes.

h. U.S. Government End Users:

The App and related documentation are "Commercial Items," and U.S. Government end users have only those rights granted to all other end users.

i. Governing Law:

The Agreement and the relationship between you and Apple shall be governed by the laws of the State of California.

Additional Notice for European Users:

If you are a citizen of any European Union country or Switzerland, Norway, or Iceland, the governing law and forum shall be the laws and courts of your usual place of residence.

Specific Exclusion:

This Agreement expressly excludes the United Nations Convention on the International Sale of Goods.
